The company meaning MemorabiliaGlory.com.The website is owned by the company and is where the company’s internet auctions will be staged. Any access to this website and dealings of any nature with memorabiliaglory.com are governed by our terms and conditions listed on this site. Please make sure you fully understand these terms and conditions as any dealings are subject to your acceptance.

General

The company makes every effort to ensure that the description, accuracy and condition of lots entered is recorded in their catalogue or on their web site to enable the purchaser to make their own judgment on suitability before bidding. Additional expert advise may be sought before entering certain lots into the company’s auction should there be any clarification on lots required. The condition and description of all lots is in the opinion of the company and no warranty or representation of fact can be offered and shall not give rise to any action in law for damages, compensation or rescission of the sale by a purchaser against the company. All lots being sold are of an age where there will be bumps and knocks and the purchaser should clarify the condition before bidding. If written claims are made by the vendor regarding their lots' history then this will be documented in the catalogue but as an agent for the vendor the company is unable to verify this and is not responsible for these claims in any way or any damages that may subsequently arise in law.

It is the purchasers’ responsibility to ask any pertinent questions and satisfy themselves regarding the condition and description of lots in the auction. The company will do their utmost to describe items with their imperfections. Not all faults are obvious and items are sold with best intentions with all their faults, imperfections and in some instances an error in description.

Any disputes regarding any auction lots must be sent by the purchaser to the company and must be received within 10 days from finish of the auction. This must be in writing explaining the reasons for the dispute listing all the evidence.

The company at its sole discretion may refuse any bids placed without explanation and has final decision without recourse on the winning bidder.

The company encourages potential purchasers to visit the office to view lots but this must be done by prior arrangement. No visits allowed during the auction live week. This visit would be entirely and completely at the persons own risk and the company cannot accept any responsibility for injury, accident or any unforeseen event to you or your property whilst on the company’s site however caused.

The legal ownership of the goods will not pass to the purchaser until the company has been paid in full for the purchase price and funds have cleared. The company shall have a lien on any lots sold until the hammer purchase price has been paid in full. All purchasers and vendors are legally obliged to supply full names and present permanent addresses by registering with the company on its official forms.

Auction Bidding Instructions

The bidding instructions for all the company’s internet auctions will be listed on the website or inside the published catalogue with full bidding explanations

Lots for inclusion in company’s auction.

All lots for inclusion in the company’s auctions must be delivered to the company’s office to allow checks, catalogue listings and photographic work to be undertaken. Other methods including collection at major auction sites or indeed selling in situ for larger items will be accepted by prior arrangement.

All goods stored at the company's premises will be held insured against the risk of theft originating from forced entry into the company's premises. The company will not be held responsible for accidental damage or breakage however caused unless the vendor has given written instructions on the lot entry form and paid an addition premium as agreed. In the event of any claims the reserve price documented would form the basis of discussion with the Insurance loss adjustor.

All lots must be entered by the sole legal owner of the items and not be subject to any credit agreement or dispute with 3rd parties. They must also be genuine original items and not replicas and also not have been the subject to any previous authenticity dispute unless written proof was documented.

Any disputes regarding any particular lots purchased must be submitted in writing to the company within 10 days explaining in full what the dispute is and backed up with as much evidence relating to the dispute as possible. As agents for the vendors the company will make any necessary contact to resolve the issue but cannot be held directly responsible for any damage claims resulting from these transactions, but will assist in the dispute at all stages.

All lots purchased are a legally binding sale so if there are any doubts by the purchaser of their inability to pay for such lots then no bid should be made. If a purchaser fails to complete the transaction and defaults on the company's terms and conditions then the damages recoverable by the vendor or the company will include any financial loss attributed to the relisting and subsequent resale of the item however attributed.

The vendor authorises the company to deduct any commission and expenses on the hammer (sold) price and its right to deduct these charges from the vendors’ final settlement. The vendor also agrees to pay £7.00 per lot for any items failing to meet their reserve.

The company cannot be held responsible in any way for the default in payment by the purchaser and any subsequent costs incurred by the vendor. The company acts as an agent for the vendor but can only pay sale realisations when funds have been received for the lot purchased.

The companies business is an Internet auction house acting on behalf of any vendors who submit items for sale. All goods received either at the company’s premises or picked up at other venues will be accepted for entry into the first available auction. These items will be photographed and entered onto the website at the company's discretion and will be subject to its terms and conditions. By entering these lots for sale then the vendor has agreed to be bound by the company's terms and conditions of sale. By entering goods into the auction the vendor will give full and absolute rights to photograph and display images either catalogued or on the website. These images can be used by the company for any marketing purpose or other reasons at its total discretion. The company only acts as an agent for the vendor who will indemnify the company against any claims in connection with any goods sold by the company on the vendor’s behalf.

Any lot entered by the vendor and subsequently withdrawn will be subject to a cost of 4.75% of the reserve price with a minimum charge of £20. The company's current commission charge is 4.75% on items selling for over £500 and 10% below this figure.

With the many new strains and well documented dangers of Internet viruses the company operates a strict virus control process to try to avoid any impact on persons viewing or downloading information from the website or email attachments. The company cannot accept any responsibility to damage caused to your systems or data however caused as a result of accessing the company website or receiving emails.

All related material on the company’s website may not be copied or used without prior permission in writing from the company. In certain instances the company may use 3rd party material for inclusion but this has to be viewed as unverified and it is the individuals’ responsibility to check any content before relying on the accuracy.

During the auction live period the company will do everything in its power to ensure that service continuity is maintained. However there are 3rd party "interruptions" that could affect service availability. The company will address any loss of internet service but ultimately cannot be held responsible for any service outages or loss of data however caused. Contingency plans will be set up during the auction period which involves hard paper copies and telephone bidding until normal service is resumed.
